Ivanhoe Activity Area Planning Scheme Amendments

On 3 June 2013 Council resolved to adopt the updated Ivanhoe Activity Area Structure Plan and to support the preparation of the associated planning scheme amendments.  The planning scheme amendments reflect the intent of the Structure Plan and will give statutory effect to the objectives of the Structure Plan.

Amendment C92 was approved and made part of the Banyule Planning Scheme on 21 November 2013.  This amendment introduces heritage controls to parts of the Ivanhoe Activity Area on a temporary basis while the permanent heritage controls are being considered.

The other amendments (C93 & C94) propose to include permanent controls in the Banyule Planning Scheme to reflect the Ivanhoe Structure Plan. Please click here for more information on these amendments.

 

Interim Controls – C91 & C92

Planning Scheme Amendment C91 – Ivanhoe Activity Area (Interim Controls)

Council resolved to adopt the updated Ivanhoe Structure Plan on 3 June 2013. Council also resolved to support the preparation and exhibition of the associated Planning Scheme Amendment.

Planning Scheme Amendment C91 proposes to make changes to different parts of the Banyule Planning Scheme to give statutory effect to Ivanhoe Structure Plan. Changes will be made to:

Design and Development Overlays (DDO)

The introduction of two new schedules to the Design and Development Overlay at Clause 43.02 of the Banyule Planning Scheme will ensure that development is well designed, environmentally sustainable and respectful of surrounding land uses and heritage places:

  • Schedule 11 to the DDO – Diversity Area Precincts (1-5). Design Guidelines will apply to each of the Diversity Precincts with the exception of Precinct 6 (the Civic Precinct) which will be subject to a separate master-planning exercise.
  • Schedule 12 to the DDO – Accessible Residential Area Precinct (Precinct 7)

This Amendment was approved by the Minister and appeared in the Government Gazette on Thursday 28 November. The interim controls will mean that planning permit applications within the Ivanhoe Major Activity Area (IMAA) boundary will be assessed in accordance with these controls while Amendment C93 for the permanent controls is considered. The interim controls will expire on 21 May 2015.

Planning Scheme Amendment C92 – Ivanhoe Activity Area Heritage Overlay (Interim Controls)

As part of the development of the Ivanhoe Structure Plan Council commissioned some further heritage work, to investigate potential heritage places and precincts in and around the Ivanhoe Major Activity Area. These areas were identified on the ‘Cultural Heritage and Identity Map’ in the Ivanhoe Structure Plan.

This heritage work resulted in the preparation of the Ivanhoe Activity Centre Heritage Items & Precincts (the Review). In order to achieve timely heritage protection for those precincts and places identified in the Review, Council requested that the Minister for Planning approve interim heritage controls through Planning Scheme Amendment C92 while Council prepared a planning scheme amendment for permanent heritage controls.

Notice of approval of Amendment C92 (interim heritage controls) appeared in the Victorian Government Gazette on 21 November 2013. Amendment C92 introduces a Heritage Overlay to two residential precincts and one individual place within the Ivanhoe Activity Area. Amendment C92 will ensure that heritage places that have been identified in the Ivanhoe Activity Area are protected from inappropriate demolitions, alterations or additions that may threaten the significance of identified heritage precincts and buildings. The two proposed heritage precincts are as follows:

Toora Street Heritage Precinct

  • 14-20 Toora Street, Ivanhoe
  • 11-23 Toora Street, Ivanhoe
  • 17-25 & 18 Young Street, Ivanhoe
  • 19-21 Linton Street, Ivanhoe

Kenilworth Parade Precinct

  • 10-36 and 17-23 Kenilworth Parade, Ivanhoe

The one place proposed to be included in a Heritage Overlay is:

  • Former Darebin Post Office at 1040-1041A Heidelberg Road, Ivanhoe.

These interim heritage controls will be in the Banyule Planning Scheme until 31 October 2014.
